Terms of Use

These terms cover your use of Flopshot, a golf round tracking app for iPhone. By using the app you agree to them. If you do not, please do not use the app.

The service

Flopshot lets you record golf rounds and practice, score a range of game formats, photograph a paper scorecard to fill in hole pars, and track statistics and a handicap index over time. Stroke play scoring is free. Other features require a Premium subscription.

The handicap index Flopshot calculates is an estimate for your own use. It is not an official handicap issued by a golf association and should not be presented as one for competition purposes.

Your account

You need an account to use the app. Keep your password to yourself; you are responsible for activity on your account. Tell us promptly if you think someone else has access to it. You must be at least 13 years old.

Subscriptions and billing

• Flopshot Premium is offered as a monthly subscription at $4.99 per month, or an annual subscription at $29.99 per year, in US dollars. Prices in other countries are set by Apple and shown to you before you buy.
• New subscribers may be offered a 3-day free trial. If you do not cancel before the trial ends, it converts to a paid subscription automatically.
• Payment is charged to your Apple Account at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours of the period ending.
• Manage or cancel your subscription in your Apple Account settings — Settings, then your name, then Subscriptions. Cancelling stops the next renewal; you keep Premium until the period you have paid for runs out.
• Apple processes all payments and handles refunds. We cannot issue refunds directly. Refund requests go to Apple.
• Prices may change. Existing subscribers are notified and, where Apple requires it, asked to consent before any increase applies to them.

Your content

Your rounds, scores, notes, photographs and other data remain yours. You grant us only the permission needed to store that data, sync it between your devices, and provide the features you use — for example sending a scorecard photograph to be read into hole pars. See the privacy policy for what is collected and who it is shared with.

Acceptable use

Please do not:

• Break the law, or use the app to help anyone else do so.
• Attempt to access other people's accounts or data, or probe, scan or interfere with the service or its infrastructure.
• Automate, scrape or resell the service, or use the scorecard scanner in bulk for anything other than your own rounds.
• Upload content you have no right to upload.

We may suspend or close accounts that do these things, and may limit usage that imposes a disproportionate cost on the service.

Availability and accuracy

The app is provided as it is, without warranty of any kind. Scorecard scanning uses automated image reading and will sometimes get a par wrong — always check the result. Statistics and handicap figures are only as accurate as the scores you enter. We do not promise the service will be uninterrupted, error free, or that data will never be lost, though we take reasonable care.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect or consequential losses arising from your use of the app. Nothing here excludes liability that cannot lawfully be excluded. Where liability cannot be excluded, it is limited to the amount you paid for the service in the twelve months before the claim.

Ending your use

You can stop using the app at any time and delete your account from inside it — open Manage account from your profile and choose Delete my account. That erases your account and its data immediately and permanently. We may suspend or end access if these terms are broken.

Changes to these terms

If these terms change materially, the date at the top will be updated and the change noted in the app. Continuing to use Flopshot after that means you accept the revised terms.

Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules.
